Terms Of Service

User Eligibility

Only individuals capable of forming legally binding contracts may use the Platform. It is not accessible to minors (under 18) or users with suspended or terminated accounts. By using the Platform, you affirm that you are of legal age and possess the authority to adhere to this Agreement. You must not permit others to use your account and accept sole responsibility for its activity.

 

Modifications to Terms

Assembler Expert may revise these Terms of Service. Any changes will take effect once you accept the updated Agreement. We may also alter hyperlinked information, with changes becoming effective upon posting. Your continued use of the Platform or Services indicates agreement to these modifications.

 

Charges for Services

As a Customer, using the Services incurs charges (“Charges”), encompassing fees, surcharges, and taxes. Assembler Expert sets and may adjust pricing, which you are responsible for reviewing and accepting. Charges apply even if a service is incomplete due to unforeseen circumstances. All Charges are processed via a third-party service and are non-refundable.

 

Coupons and Payments

Coupons received can be applied to Charges and are exclusive to the Platform. They are non-transferable and non-redeemable for cash, with certain restrictions. Assembler Expert may pre-authorize your payment method to verify funds and safeguard against unauthorized use. You are liable for any overdraft or NSF fees incurred due to authorization holds.

 

Fees for Service

Assembler Expert will provide you with a price quote for the service when you request it. Please note that this quote is subject to change until we receive confirmation from both you and the Technician.

 

Other Charges

If you cancel a service after requesting it through the Assembler Expert Platform, be aware that there may be a cancellation fee. Additionally, if you are not present at the service location during the confirmed appointment window, you may incur charges. Other potential fees include state or local fees and processing fees. Assembler Expert will also collect any applicable taxes or other legal costs as required.

 

Service Completion

After completing the service, you have the option to tip your Technician in cash. Any tips given will be kept by the Technician.

 

Payments to Technicians

Technicians will receive payment for their services as agreed upon in this Agreement and any other relevant agreements with Assembler Expert. Payments are calculated by Assembler Expert and confirmed by the Technician when they agree to perform the service. If a Technician cancels the service, they may be charged a cancellation fee. Technicians may also receive tips from customers and any damage charges collected on their behalf.

 

Technician Payment Collection

Assembler Expert, through its third-party payment processor, will handle payments owed to Technicians as your limited payment collection agent. The receipt of payments by Assembler Expert satisfies your obligation to pay. Assembler Expert reserves the right to adjust or withhold payments, except for tips, in a reasonable manner and will make efforts to remit payments to you weekly, subject to reasonable business practices and uncontrollable events.

 

Communications

By using this Agreement or the Platform, you agree to receive communications from us, including emails, text messages, phone calls, and push notifications. You consent to texts, calls, or prerecorded messages generated by automatic systems. We may send communications about your account, new features on the Platform, promotions, and news about Assembler Expert. Standard text messaging charges apply.

 

Your Information

Your Information includes any data you provide or post on the Assembler Expert Platform or send to other users. You consent to us using your Information to create an account for you and participate in our Services. Our use of personal information is outlined in our Privacy Policy. You are responsible for your Information and interactions with others on the Platform.

 

Promotions and Discounts

Assembler Expert may offer promotions with various features. These promotions do not affect your Agreement or relationship with us unless otherwise stated.

 

Restricted Activities

When using the Assembler Expert Platform and participating in our Services, please adhere to the following guidelines:

• Do not impersonate anyone or any entity.
• Avoid stalking, threatening, or harassing others.
• Comply with all applicable laws and regulations.
• Refrain from disrupting the Assembler Expert Platform or its associated networks.
• Do not post or engage in fraudulent, libelous, abusive, obscene, profane, sexually oriented, harassing, or illegal activities on the Platform.
• Ensure that your use of the Platform does not infringe on third-party rights.
• Never transmit malicious code or programs that could harm computer systems or personal information.
• Do not manipulate identifiers to disguise information transmission origins.
• Avoid “framing” or “mirroring” parts of the Assembler Expert Platform without authorization.
• Do not modify, translate, reverse engineer, decipher, decompile, or otherwise disassemble any part of the Platform or related software.
• Refrain from renting, leasing, lending, selling, redistributing, licensing, or sublicensing the Platform or access to it.
• Do not use robots, spiders, site search/retrieval applications, or other devices to reproduce or circumvent the navigational structure of the Platform.
• Transfer or sell your User account and related credentials to others is prohibited.
• Discrimination and harassment based on race, national origin, religion, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation are strictly forbidden.

 

Service Provider/Technician Agreements

As a Technician providing Services on the Assembler Expert Platform:

• You must collect payments only through authorized channels on the Platform.
• You are responsible for any damages caused during service and must compensate accordingly.
• Maintain a professional demeanor while performing Services.
• Ensure you have a valid driver’s license and are fit to operate a vehicle for service provision.
• Use only your own property in good condition for Services and comply with safety standards and legal requirements.
• Avoid reckless behavior and ensure the safety of Users and third parties during Services.
• Do not attempt to defraud Assembler Expert or Customers. If suspected of fraud, payments may be withheld.
• You agree to provide necessary authorizations for background checks. Maintain liability insurance coverage as required by Assembler Expert. Pay all applicable taxes based on your Services and payments received.

Intellectual Property

Assembler Expert owns all intellectual property rights in the Assembler Expert Platform, including database rights, copyright, design rights, trademarks, and other similar rights globally. All trademarks, logos, service marks, company or product names on the Platform are owned by their respective owners. Submissions provided by users become the sole property of Assembler Expert upon creation or provision.

 

Assembler Expert’s logos and designs are registered trademarks in the United States and other countries. Users must not use or create materials that infringe on these trademarks without written authorization.

 

Users agree not to impair the validity of Assembler Expert’s trademarks or use them in unauthorized ways. They also agree not to challenge Assembler Expert’s ownership of these trademarks or apply for trademark registration of any related marks.

 

If users create materials with Assembler Expert’s trademarks without authorization, they grant Assembler Expert exclusive rights to these materials and agree to transfer any interest in them.

 

Assembler Expert respects others’ intellectual property and expects users to do the same. Users should report any copyright infringement on the Platform.

 

Disclaimers

Assembler Expert cannot guarantee the completion or quality of services performed by Technicians. The Platform does not guarantee specific results, accuracy, reliability, security, or availability. It disclaims all implied warranties and is not responsible for personal property or unauthorized use of user accounts.

 

Assembler Expert is not responsible for users’ conduct online or offline. Users are responsible for their interactions and must accept risks associated with using the Platform and participating in Services.

 

Users must notify Assembler Expert immediately if they suspect unauthorized use of their account or a security breach.

 

Assembler Expert does not guarantee the accuracy of location data provided by the Platform. It is not responsible for any loss or damage resulting from reliance on third-party content posted on the Platform.

 

Location data is for basic purposes only and may not be precise. Assembler Expert does not guarantee the availability, accuracy, completeness, reliability, or timeliness of this data.

 

Users’ information may be accessible to Assembler Expert and certain users of the Platform.

 

Indemnity Clause: 

You agree to protect Assembler Expert and its affiliates, subsidiaries, parents, successors, and assigns, as well as their officers, directors, employees, attorneys, agents, or shareholders. This means you will cover them for any legal claims or costs that may arise from your use of the Assembler Expert Platform and services.

 

This includes:

• Any breach of this Agreement or related documents.
• Violations of laws or third-party rights due to your interactions.
• Allegations that your submitted materials infringe on third-party intellectual property rights.
• Your use of personal property in connection with the services.
• Any other activities related to the services.
• This indemnity applies regardless of any party’s negligence.

Limitation of Liability:

Assembler Expert and its related entities will not be responsible for any indirect or consequential damages resulting from the use of the Assembler Expert Platform or services. This includes damages from data loss, service interruptions, or costs associated with obtaining substitute services. While you can request services from third parties through the platform, Assembler Expert is not liable for those third-party services unless stated otherwise in this Agreement.

 

Term and Termination:

This Agreement starts when you begin using the Assembler Expert Platform. You can end this Agreement by giving Assembler Expert seven days’ notice. Either party can also terminate immediately if there is a significant breach of this Agreement. Assembler Expert may also deactivate your account if you no longer meet the requirements to provide services or if there is a concern for community safety. In such cases, you will be notified and given a chance to resolve the issue before permanent termination. If a breach is fixed promptly and to Assembler Expert’s satisfaction, this Agreement will continue.

 

Please note that some jurisdictions may not allow certain limitations on damages. If applicable laws affect you, some parts of this Agreement may not apply.

 

Indemnity

By using the Assembler Expert Platform and participating in the Services, you agree to release, defend, indemnify, and hold Assembler Expert, our affiliates, subsidiaries, parents, successors, assigns, and all respective officers, directors, employees, attorneys, agents, and shareholders harmless. This includes any claims, actions, suits, losses, costs, liabilities, and expenses (including reasonable attorneys’ fees and costs) arising from the following:

• Your breach of this Agreement or related documents.
• Violation of any law or third-party rights due to your interactions.
• Allegations that materials you submit infringe intellectual property rights.
• Ownership, use, or operation of personal property related to the Services.
• Other activities connected to the Services.

This indemnity applies regardless of negligence by any party.

 

Limitation of Liability

Assembler Expert, including our affiliates, subsidiaries, parents, successors, assigns, and respective officers, directors, employees, agents, or shareholders (collectively “Assembler Expert”), will not be liable to you for incidental, special, exemplary, punitive, consequential, or indirect damages. These include deletion, corruption, loss of data, program failure, or service interruptions related to the Assembler Expert Platform, the Services, or this Agreement. Even in cases of negligence, Assembler Expert’s liability remains limited.

 

While you can use the Assembler Expert Platform to request services from third-party providers, Assembler Expert assumes no responsibility or liability for such services beyond what is expressly stated in this Agreement. Note that certain jurisdictions may not allow the exclusion or limitation of certain damages, so additional rights may apply to you.

 

Term and Termination

This Agreement becomes effective upon your use of the Assembler Expert Platform. Termination options include:

• User Termination: You may terminate this Agreement without cause by providing seven (7) days’ prior written notice to Assembler Expert.
• Immediate Termination: Either party can terminate this Agreement immediately, without notice, due to the other party’s material breach of any provision.
• Assembler Expert’s Termination: Assembler Expert may deactivate your User account if:
• You no longer qualify to provide Services or fail to comply with rules, permits, ordinances, or regulations.
• Your star rating falls below Assembler Expert’s threshold.
• Assembler Expert believes such action is necessary to protect community safety or third parties.
• In cases (1)-(3), you’ll receive notice and an opportunity to address the issue before permanent termination.

For other breaches, you’ll also receive notice and a chance to cure the breach. If resolved promptly to Assembler Expert’s satisfaction, this Agreement won’t be permanently terminated. Provisions naturally surviving termination remain in effect.

Dispute Resolution and Venue

This Agreement is governed by Illinois law (excluding choice of law rules). Jurisdiction and venue for any action lie exclusively in state or federal courts serving Dupage County, Illinois. The parties irrevocably consent to this jurisdiction and venue. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

 

Confidentiality

You agree not to use Assembler Expert’s proprietary and confidential information (referred to as “Confidential Information”) for any purpose other than contemplated herein. Confidential Information includes details about Users (e.g., name, location, contact info, photo) made available to you through the Assembler Expert Platform. You must not disclose it to third parties. Take necessary measures to protect its secrecy and prevent public disclosure.

Exceptions:

• Confidential Information already in the public domain or entered there without fault.
• Information known to you without restriction at the time of disclosure.
• Information disclosed with Assembler Expert’s prior written approval.
• Information obtained from a source other than Assembler Expert without violating rights.
• Disclosure pursuant to a court order or governmental requirement. Promptly notify Assembler Expert in such cases to seek protective measures

Other Services

In addition to connecting Users, the Assembler Expert Platform facilitates Users in providing or receiving goods and services from third parties (collectively referred to as “Other Services”). You acknowledge that these Other Services are subject to the terms and pricing set by the third-party providers. Should you choose to purchase Other Services through the Assembler Expert Platform, you authorize Assembler Expert to charge your designated payment method based on the agreed-upon pricing terms. It is important to note that Assembler Expert assumes no responsibility and cannot be held liable for the Other Services or any actions or omissions of the third-party providers. These Other Services are not actively investigated, monitored, or verified by us, and we do not assume responsibility for their accuracy, appropriateness, or completeness.

 

Additional Terms

Certain Services may have specific Terms that are not covered in this document. In such cases, Service-specific Terms will be presented to the Customer during the purchasing process. By requesting a Service, the Customer agrees to any additional Terms associated with that Service.

 

Severability

If any provision of this Agreement becomes invalid or non-binding, the remaining provisions shall remain in force. In such an event, the parties will replace the invalid provision with valid and binding terms that achieve a similar effect, considering the Agreement’s contents and purpose. Assembler Expert reserves the right to automatically assign this Agreement and all incorporated agreements at its sole discretion, with notice provided to you. Unless explicitly stated otherwise, any notices to Assembler Expert should be sent by certified mail, postage prepaid, and return receipt requested to the address: Assembler Expert, 4609 Fairview Ave, Downers Grove, IL 60515. Notices to you will be delivered through the Assembler Expert Platform or via the email address or physical address you provided during registration. Headings in this Agreement serve for reference purposes only and do not limit or define the scope of any section. The terms “include,” “includes,” and “including” imply “without limitation.” A party’s failure to act regarding a breach by the other party does not waive the right to act in response to subsequent or similar breaches. This Agreement represents the entire understanding and agreement between you and Assembler Expert, superseding all prior oral or written understandings and agreements between the parties.
