Chargeback & Cancellation Policy (Effective: May 1st, 2023)
1. Chargebacks and Resolution:
- Chargebacks should not be necessary. If you suspect fraudulent use of your credit card, debit card, or payment method on our website, wish to cancel an order, or have any other concerns, please reach out to us directly. We are here to assist you promptly.
- In cases where we anticipate a chargeback, we may temporarily withhold the transaction amount until the dispute period expires, the chargeback is resolved, or we determine that a chargeback will not occur.
2. Payment Methods:
- We accept Visa, Mastercard, Discover, and American Express.
- By clicking “I Agree,” you authorize us to charge your card or payment method. This authorization constitutes a binding agreement, and you waive the right to file a chargeback for any reason.
3. No Chargebacks:
- You agree not to file a chargeback for any amounts charged on our website. Instead, please contact us directly to address any disputes or concerns related to orders or charges.
4. Recovery of Chargebacks:
- If you initiate a chargeback for a valid payment, we reserve the right to recover the disputed amount through appropriate means. This may include recharging your card or involving a collection agency.
- In cases where you successfully recover funds owed to us through a chargeback, we will provide documentation to the payment method provider to demonstrate that you received the product or service.
5. Invoice and Legal Remedies:
- We may issue an invoice or bill for any product or service sold and delivered to you. By initiating a chargeback dispute, you agree to pay the invoice in full.
- Failure to make appropriate payment may result in legal and equitable actions as permitted by law.
6. Recovery of Chargeback Costs:
- We are entitled to recover chargebacks imposed by payment method providers or third parties, along with associated fees, fines, expenses, or penalties.
- These amounts may be debited from your account or offset against any outstanding balances.
Contesting Chargebacks
As part of our process, you agree to assist us, at your expense, in investigating any transaction related to a chargeback. Cooperation is essential, and we may request information from you for the purpose of contesting or investigating chargebacks. These requests will be sent to the email address you provided, and we expect a comprehensive response within fourteen (14) days, unless a different timeframe is specified.
Even if access to our website, products, or services is terminated for any reason, we retain the right to contest and recover chargebacks from you. This also applies to any party that has provided us with a guarantee or security related to your obligations under this policy.
Return of “Product Not As Described”
We kindly request that you refrain from filing chargebacks for the reason of “Product Not As Described.” If you wish to dispute an order or charge, please follow the appropriate process for a return or cancellation rather than initiating a chargeback.
Chargeback Fraud
Fraudulent chargebacks occur when a customer disputes a charge for a product or service they have actually purchased. Attempting to dispute a valid credit card charge is both fraudulent and illegal. We take chargeback fraud seriously and follow this procedure when it occurs:
1. Initial Contact:
- If you attempt to dispute a valid charge, we will first reach out to you directly. Often, disputed charges result from customers not recognizing our charge on their statement.
- You will have ten (10) calendar days to reverse your dispute upon receiving our email, letter, or phone call.
2. Escalation:
- If you do not reverse the dispute or attempt to resolve the situation, we will file a police report with your local authorities and pursue criminal charges.
3. Collection Process:
- Your account will be referred to a collection agency, which will initiate collection activities and report your account as delinquent to major credit bureaus.
4. Legal Action:
- If the situation remains unresolved—either by reversing the dispute or reimbursing us for the disputed amount plus bank fees—we will file a civil lawsuit against you.
- This lawsuit will seek the disputed amount, bank fees related to the chargeback, additional damages due to harm caused to our merchant credit record, and punitive damages.
Chargeback Abuse Policy
By using our services, you agree not to abuse any Payment Method provider’s Chargeback policy or this Chargeback Policy.
In the event that you file a Chargeback and it is resolved in our favor by the Payment Method provider, you are obligated to promptly terminate the Chargeback with the Payment Method provider. Additionally, you agree to reimburse us for any costs incurred during the research and response process related to the Chargeback. These costs include, but are not limited to, actual expenses paid to the credit card processor or our banks, fees paid to other third parties, and the reasonable value of the time spent by our employees and owners on the matter. The determination of these costs will be made in our discretion and good faith.
Should a Chargeback be placed or threatened on a purchase, we reserve the right to report the incident to Chargeback abuser database(s) of our choosing, at our sole discretion. The information reported may include your name, email address, order date, order amount, IP address, full address, and phone number. Being listed in such databases could significantly hinder your ability to use credit cards for future purchases with us or other merchants. To be removed from the database, Chargeback abusers must settle any outstanding amounts owed to us, along with an additional $150 for processing and handling, via wire transfer or other means as we may require. Legal fees and collection costs incurred during this process will also be added to the total collection amount owed by the abuser.
ALL UNRESOLVED CHARGEBACK ABUSE ISSUES WILL BE PROMPTLY REPORTED TO MAJOR CREDIT BUREAUS, CHARGEBACK ABUSERS DATABASES, AND COLLECTION AGENCIES. THIS CAN SEVERELY IMPACT CREDIT RATINGS FOR UP TO 7 YEARS.
Cancellation Policy
We understand that unforeseen circumstances may require you to cancel or reschedule your service appointment. While we aim to be flexible, we also respect our Service Providers’ time and resources.
- Appointment Cancellation: Customers may cancel their appointment for any reason up to 72 hours before the scheduled arrival window without incurring any charge or penalty. Appointments canceled with less than 72 hours’ notice before the arrival window will result in a Cancellation Fee equal to 30% of the original service cost estimate.
- Appointment Reschedule: Customers may reschedule their appointment for any reason up to 72 hours before the scheduled arrival window without any charge or penalty. Appointments rescheduled with less than 72 hours’ notice before the arrival window will incur a Reschedule Fee equal to 30% of the original service cost estimate.
